You may use Products and Services solely for personal education and professional development. You may not use them to build competing products, establish a competing business, or post any content to third-party sites.

JB Learning may invalidate results or suspend your account if there is reasonable cause to question assessment validity. Suspected breaches may be reported to licensing bodies, institutions, and law enforcement.
All Site content, Products, and Services are owned by JB Learning or its licensors and protected under intellectual property laws. You may not reproduce, distribute, modify, or create derivative works without written permission. Brands include: Ascend Learning, JBL, Public Safety Group (PSG), ECSI, FISDAP, and CDX Learning Systems.

Your permissions terminate automatically if you breach these Terms. Violations may result in score invalidation, account suspension or termination, disciplinary action by your institution, and civil or criminal penalties. Upon termination, you must cease all use of Products and Services and remain liable for any outstanding fees.
You may not use Products and Services to train, develop, or improve any AI systems or models. Where JB Learning offers Generative AI features, output may not always be accurate and must be evaluated before use. You must not rely solely on AI-generated output for decisions that could have legal, health, or other material impact on individuals.
JB Learning collects personal and usage data ("Your Data") to operate and improve Products and Services, verify test security, generate performance reports, and provide technical support. Your Data will not be sold or rented without your consent. It may be shared with affiliated institutions, regulatory bodies, or as required by law.
Aggregate and de-identified data may be used for benchmarking, research, and analytics. Voluntary user postings to JB Learning platforms are non-confidential and may be used by JB Learning for any commercial or non-commercial purpose.
If remote proctoring is elected by you or your institution, you authorize JB Learning and its proctoring providers to monitor and record you, your environment, and your computer display via webcam, microphone, and screen capture. Recordings may be shared with your institution. You may not record any part of a remote proctoring session.
Products and Services are provided "as is" and "as available" without warranty of any kind. JB Learning disclaims all express and implied warranties including merchantability, fitness for a particular purpose, and non-infringement. JB Learning does not warrant that the Services will be uninterrupted or error-free.
To the maximum extent permitted by law, JB Learning's total liability for any claim arising from use of Products and Services shall not exceed $100.00. JB Learning is not liable for indirect, incidental, punitive, or consequential damages including lost profits or data loss.
You agree to indemnify and hold harmless JB Learning, its directors, officers, employees, agents, and suppliers from any claim arising out of your breach of these Terms or your use of Products and Services.
These Terms are governed by the laws of the Commonwealth of Massachusetts. Exclusive jurisdiction rests with Massachusetts courts, and both parties waive the right to a jury trial. JB Learning may update these Terms at any time; continued use constitutes acceptance of any changes.
